Association Policies

Renovation Procedures - Owners are to submit a rough sketch/drawing with a written description of all plans for any renovations to their unit (i.e., interior or exterior flooring, remodeling, alterations and/or modifications to the structural design, etc.), to the Kepuhi Beach Resort/Property Manager, and Dale Matlock . The Owner must await written approval, before beginning any physical work. Owners are to acquire all applicable permits. Upon receiving approval from the Board, you will receive a letter with additional rules to follow (see Owner Remodel/Renovation Information below). There will be steep fines assessed to those that do not comply with this procedure.

Louvers - The Kepuhi Beach Resort (your Board) will purchase the wood/materials and contract the installation for new louvers (on an as needed basis), and charge back 50% of related costs to the Homeowner of the unit. The mechanisms are the sole responsibility of the Homeowner.

Doors & Jambs - The Kepuhi Beach Resort will assume 40% of repair costs and the Homeowner 60%. Again, the work will be contracted out with the exception of those Owners that have indicated and demonstrated to the Board an expertise in this area and wish to conduct the work themselves.

Keys Left for Emergencies - All Owners are requested to supply the Kepuhi Beach Resort/Property Manager with a key to their unit (for emergency access) that will be kept under lock and key. If no key is provided and an emergency arises, access will be gained by whatever means necessary and the Owner will assume responsibility for all costs.

Mailbox Slot - A mailbox slot will be installed in the office door as a drop box for Owners that have renovation requests, suggestions or submittals for the Board and/or Kepuhi Beach Resort/Property Manager. Please put all letters in a sealed envelope, & address to the intended recipient for security and privacy purposes.

Locker Rental Policy After purchasing a unit at the Resort, the new Owner will be given first right of refusal for a locker that the previous owner of their unit occupied. Thereafter, occupants of each building (or cottage duplex) will be given first priority to have a locker in their building/cottage duplex. However, any Owner of our Resort may rent the locker if the Owner in that building/duplex, did not already have their name on the waiting list.

Owners deeded to more than one unit are eligible to have one storage locker per unit, so long as another Owner does not have their name on the waiting list for the next available locker. If an Owner has more than one locker, and another owner with no storage unit requests a locker, the owner with multiple lockers will be required to surrender the locker of choice.

The Kepuhi Beach Resort Property Manager will maintain a waiting list of owners desiring storage. The units will be assigned with the above priorities as a guideline.

If you would like to be put on the waiting list, please put your request in writing and drop in the mail slot at the Kepuhi Beach Resort/Property Manager's Office (Unit#1171) or email Connie Fox.

Owner Remodel/Renovation Information

Homeowner's Construction Letter

Dear Homeowner:

We are pleased that you have chosen to upgrade your unit. We ask that you provide the Board with a simple sketch of your unit diagramming all remodeling/renovation plans as well as a detailed letter explaining your intent, and the name of the Contractor that will be overseeing your project. Upon acceptance of your plans, the Board will email a written response of approval allowing you begin your renovation.

We ask that you and your Contractor comply with all rules listed below. We have enclosed a duplicate copy of this letter for you to present to your Contractor. It will be your responsibility to see that your Contractor strictly adheres to all rules. The rules were put in place to protect our property and ensure that disturbance to your neighbors is kept to a minimum during the construction/remodeling phase.
  1. No driving over the walkways, sidewalks, or on "greenbelts," etc. This is strictly prohibited as it breaks sprinkler heads and damages the lawn. A vehicle pass may be obtained from the Property Manager (or an approved staff member) for unique circumstances. This pass must be signed by the Property Manager and placed in clear view inside the windshield and will be permitted for no more than one day.
  2. Any work that causes noise (drills, hammering, etc.) is to be conducted between 9am and 5pm ONLY.
  3. No noise AT ALL on Saturday's, Sunday's and Holiday's.
  4. Radios must be kept at a low volume and only operated within the interior of the unit, so as not to disturb any other owners or guests. If there is a complaint, the use of the radio must be discontinued.
  5. Temporary storage of construction materials on the lanais may not exceed 30 days.
  6. Thorough clean up is required at the end of each day.
  7. Crush ALL cardboard before placing in the dumpster. This is to be only small boxes that have been broken down. ALL other constructional refuse is to be driven to the landfill near town (Kaunakakai). See Contractor's Construction Letter.
  8. Under no circumstances is an Owner or Contractor to solicit the services of our working crew/staff during posted working hours.
  9. The Board has approved the following sanctions:
    • 1st offense $250
    • 2nd offense $500
  10. Should you hire a contractor who has violated the house by-laws, we will disclose the history of his infractions, if known, when we send you the Board's stamp of approval to begin your renovation. You may then hire him/her with an educated risk. Subsequent violations made by this same Contractor will result in a fine of $250 for the 1st offense while on your job with subsequent fines imposed as deemed necessary. It is the responsibility of the Homeowner to inform their Contractor of these rules and provide him/her with a copy of the Contractor's Letter from this site. Any violations made by the Contractor will be the financial burden of the Homeowner.

    Fines for Failure to Comply with Association Renovation Rules

    If a Homeowner does not properly request permission from the Board, in writing, to renovate or make changes to their unit (i.e., adding a washer/dryer, changing/modifying cabinets, flooring, electrical, plumbing - ANYTHING except for painting or window coverings), there will be NO WARNING LETTER and they will be fined $250 immediately. Offending Owner's will be ordered to cease work immediately and may not resume again until the Board has received the renovation plans and the Board responded with an approval letter. A Homeowner must receive approval IN WRITING by the Board before any work ensues. Ignorance is not an excuse.

    If an Owner finishes their renovation without making the Board aware of their plans and obtaining written approval from the Board, they will be fined $500, payable immediately or legal procedures will be initiated. This will be a no tolerance policy. Upon notifying the Board of your wishes to renovate, a Board Member will email letters to you and your Contractor with additional rules to follow.

    Had the Owner gone through proper channels, they would automatically have received a copy of the above policy. These policies have been made public at Homeowner's Meetings and reiterated in the typed minutes of the Homeowner's Meetings and mailed to all Owners.

    Be sure to submit your proposed project in writing (via email or mail) to Dale Matlock to get board approval before you remodel. Failure to comply will result in a $250 fine. Contractor's Construction Letter

Dear Contractor:

Welcome to Kepuhi Beach Resort. We are pleased to have you on the property. We ask that you familiarize yourself with the rules of our Association by reading the information that follows. We ask that you strictly adhere to all rules. These rules were put in place to protect both our Homeowner's and the resort property and ensure that any disturbance to our Resort or its occupants will be kept to a minimum during the construction/remodeling phase.

Subsequent violations made by you will result in a fine of $250 for the 1st offense with escalations as previously stated. There will be NO LETTER of warning should you take on a job with a new Homeowner as you have already been issued a warning or been served a fine from a previous job. You have been made well aware of these rules.
